Terms & Conditions

(A) These terms and conditions (“Terms”) govern the access to and use of services made available on or through https://aliviotechnologies.com/ and/or the Alivio Technologies Pvt. Ltd. mobile application and website (collectively referred to as the “Platform”), and the services provided
thereunder (“Services”). 

These Terms are framed in accordance with the Information Technology Act, 2000, and the rules, regulations, guidelines, and amendments made thereunder, including but not limited to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as applicable in India.

These Terms also incorporate and include our Privacy Policy, and any additional guidelines, policies, notices, disclaimers, or supplemental terms issued by Alivio Technologies Pvt. Ltd. from time to time (“Supplemental Terms”).

The Privacy Policy and Supplemental Terms shall form an integral and legally binding part of these Terms. In the event of any inconsistency or conflict between these Terms and any Supplemental Terms, the Supplemental Terms shall prevail to the extent of such inconsistency.

By accessing or using the Platform or availing any Services, the user agrees to be bound by these
Terms, the Privacy Policy, and all applicable laws and regulations in force in India.

(B) These Terms constitute a binding and enforceable legal agreement between Alivio Technologies Pvt. Ltd., a company incorporated under the Companies Act, 2013, having its registered office in India, and its affiliates (collectively, “Alivio,” “we,” “us,” or “our”), and you, an independent third party service provider (“you” or “Service Professional”).

 By accessing the Platform or using the Services, you represent and warrant that you have reached the age of majority under applicable Indian laws and possess the full legal capacity, authority, and competence to enter into and be bound by these Terms. 

If you access or use the Services on behalf of any other individual, firm, partnership, company, or legal entity, you further represent and warrant that you have the necessary power, authority, and authorization to bind such person or entity to these Terms, and that such person or entity shall be fully bound by the same.

(C) For the convenience of users, Alivio Technologies Pvt. Ltd. may publish or make available translations of these Terms in one or more languages other than English. Such translations are provided for reference purposes only.

In the event of any inconsistency, discrepancy, or difference in interpretation between the English version of these Terms and any translated version, the English version shall prevail, govern, and be binding for all purposes.

(D) By accessing or using the Services, you acknowledge and agree that you have read, understood, and accepted these Terms, as may be amended, updated, or modified from time to time, and that you shall comply with all obligations, conditions, and requirements set forth herein.

These Terms supersede and replace all prior or contemporaneous agreements, understandings, or arrangements, whether written or oral, entered into between you and Alivio Technologies Pvt. Ltd. in relation to the subject matter hereof.

If you do not agree with these Terms or are unable to comply with any of the requirements contained herein, you must immediately refrain from accessing or using the Services. 

3. Membership Eligibility

Use of the Alivio Technologies Pvt. Ltd. website, mobile application, and related services (collectively, the “Platform” and “Services”) is available only to persons who are competent to enter into a legally binding contract under the Indian Contract Act, 1872.

Persons who are deemed “incompetent to contract” within the meaning of the Indian Contract Act, 1872, including but not limited to minors, undischarged insolvents, and persons of unsound mind, are not eligible to access, register on, or use the Platform or avail any Services, whether online, through the mobile application, or via telephonic means.

Without limiting the foregoing, individuals under the age of eighteen (18) years are strictly prohibited from registering as members, transacting on the Platform, placing orders, or availing any Services in any manner whatsoever.

4.Use of Our Services

By registering on the Alivio platform, you acknowledge and agree that:

(a) The Services include access to and use of Alivio’s digital platform, which enables you to provide various home-based and on-site services to end customers registered on the Platform (“Customers”). Customers may include both individual consumers as well as business entities such as hotel chains, schools, colleges, restaurants, hospitals, and direct last-mile clients, from whom Letters of Intent (LOIs) may be received.

As part of the Services, Alivio shall:

(i) Provide technical assistance to the Partner where reasonably required for use of the Platform.

(ii) Assist the Partner in determining the amounts payable by Customers for the services rendered, in accordance with platform policies and commercial terms.

(iii) Facilitate the efficient utilisation of the Partner’s working time while performing Services through platform tools and operational support.
(iv) Take commercially reasonable measures to enhance the Partner’s earning potential through use of the Platform.
(v) Facilitate the collection and transfer of payments from Customers to the Partner for services rendered, and may collect such payments on the Partner’s behalf in accordance with applicable laws and payment-processing arrangements in India.

 
(b) Service Professionals engage with Alivio solely as independent partners or micro-entrepreneurs and not as employees or agents. You remain fully responsible and liable for all services offered or provided through the Platform, including compliance with applicable laws. Nothing herein creates any employer–employee or partnership relationship with Alivio. The Platform is for commercial use only and may be used solely within India.

(c) We will intimate you the bookings or any kind of updates through WhatsApp or mail from our registered ID ( info@aliviotechnologies.com), from our registered mobile number 9051551925.

(d) Service Professionals having more than 10 years’ experience or between 5–10 years’ experience shall not be charged for training; however, periodic online training sessions—technical or non technical—may be conducted where required. Freshers, ITI pass-outs, and selected professionals with 1–5 years of experience shall undergo a detailed practical training programme of up to three months, and upon successful evaluation may be onboarded as Alivio Partners.

(e) Partners may be offered domain-specific training based on their performance ratings to help improve service quality and receive continuous leads through the Platform, thereby enhancing their earning potential. Such training may be chargeable, and any applicable fees shall be communicated to Partners in advance through official communication channels.

5. ACCOUNT CREATION & ONBOARDING

(a) Partners must register on the Alivio platform by providing accurate personal details and uploading valid documents such as Aadhaar Card, PAN Card, RC Book, Driving Licence, police verification copy, and a cancelled cheque, as required on the portal.                           

1. The Partner must onboard through the website (www.aliviotechnologies.com), submit the Partner Evaluation Form, and complete mobile number verification through OTP. The Partner is strictly advised not to share the OTP with anyone. 

2. The Partner shall pay a non-refundable annual fee of ₹200 / year after successful submission and uploading of all required and valid documents. 

3. After evaluation by Alivio’s technical team, the Partner shall be informed through WhatsApp and email regarding further proceedings. 

4. If the Partner successfully qualifies in the evaluation round, the Partner shall be required to purchase the necessary toolsets through Alivio’s portal. 

5. Upon purchase of the toolkits, Alivio shall provide formal online training and assign a service zone (within a 60-km radius) for allocation of service tickets. 

6. If a Partner does not qualify in the evaluation round; Alivio offers an opportunity to undergo a skill enhancement program. The Partner may be required to complete a three month physical training program to improve their skills. The training fee is ₹30,000, which may be paid in instalments or via EMI options facilitated through Alivio’s banking channel partners. However, Alivio shall not act as a guarantor for any such loan under any circumstances. Upon successful completion of the training, the Partner will be eligible to be deputed as an official Alivio Partner.

6. DISCLAIMERS AND WARRANTIES

(a) Except as expressly stated, the Contractor provides no warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or uninterrupted service. However, purely as a goodwill gesture and without creating any ongoing obligation, the Contractor shall provide a limited warranty of seven (7) days from the date of service for equipment only, which the Partner must honour by rectifying any covered issues free of cost. This limited warranty shall not apply to defects arising from normal wear and tear, misuse, improper operation, voltage fluctuations, external causes, consumables, spare parts, or third-party intervention. The Contractor’s sole obligation shall be, at its discretion, to re-perform the affected service, and no monetary liability
or extended warranty shall arise. A signed or digitally acknowledged Field Service Report (FSR) shall be final and binding for all warranty and service-related verification purposes.

(b) The Partner represents and warrants that all licences, permits, authorisations, and tax  registrations required under applicable Indian laws and industry standards have been duly obtained to provide the Services. The Partner further acknowledges that arranging any helper or support staff
shall be solely the Partner’s responsibility, and complete details of such helper(s) must be uploaded on the Platform prior to service delivery.

(c) The Partner shall not engage or use child labour under any circumstances while performing the Services. Any helper engaged must be of the same biological sex as the Partner, and the Partner shall not engage more than one (1) helper while providing a Service to a Customer. 

(d) Any breach of these Terms by a helper shall be deemed to be a breach by the Partner and shall be dealt with accordingly under these Terms. The Partner agrees and acknowledges that no employment relationship exists between Alivio and any helper, and that the helper is engaged solely by the Partner in the Partner’s capacity as an independent contractor. The Partner shall be solely responsible for compensating the helper on the terms agreed between the Partner and the helper.

(e) Alivio shall not be liable to compensate any helper for the provision of Services, nor for any expenses incurred or assistance rendered by the helper to the Partner. Further, Alivio shall not be liable to pay the Partner any additional compensation for engaging a helper. The engagement of any helper shall not be construed as an assignment, transfer, delegation, sub-delegation, or subcontracting of the Partner’s obligations under these Terms. In all circumstances, the primary responsibility and liability for performance of the Partner’s obligations under these Terms shall remain with the Partner. Any act, omission, misconduct, accident, or mishap caused by the helper, including any damage to property or injury to persons or any resulting legal consequences, shall be the sole responsibility of the Partner, and the Partner shall bear all associated costs, liabilities, penalties, and claims arising therefrom. 

(f) You acknowledge and agree that you will purchase all the spare Parts from Alivio Portal only.

(g) Alivio shall maintain a complaints management framework and manage such framework on behalf of Service Professionals in a reasonable manner and in accordance with the non-excludable requirements of applicable Indian laws.

(h) You agree that your continued use of the Services is subject to you maintain a minimum threshold of ratings based on Customers’ reviews.

(i) You are responsible for obtaining the data network access required to use the Services, and your mobile operator’s data and messaging charges may apply, for which you shall be solely responsible. You must procure and maintain compatible hardware or devices necessary to access the Platform, and Alivio does not guarantee that the Services will function on any specific device or hardware.

(j) 

7. Cancellation of services:

If a Partner repeatedly cancels bookings, Alivio reserves the right to suspend or block the Partner’s account in accordance with applicable Indian laws. A Partner may reschedule a ticket a maximum of two (2) times, and the ticket must be closed within forty-eight (48) hours, failing which appropriate action may be taken.

8. Modification of Alivio Privacy Policy

We reserve the right to modify or update our Privacy Policy from time to time. Partners are required to review and accept the updated policy available on our website. It shall be deemed that Partners will periodically check the revised policy and accept the same, as Alivio will not provide separate notifications or update links for such changes.

9. Ownership of Intellectual Property

9.1 All textual content, graphics, editorial material, data, formatting, graphs, designs, HTML, visual elements, photographs, music, sounds, images, software, videos, typefaces, and other content, including the selection, arrangement, coordination, and enhancement of such materials, displayed or accessible on the Alivio website or mobile application, are the exclusive property of Alivio and are protected under the Copyright Act, 1957, as amended from time to time.

9.2 Alivio exclusively owns all Intellectual Property Rights associated with the Website and App, including but not limited to copyrights, patents, trademarks, trade names, service marks, designs, trade secrets, and other proprietary materials. Partners and users agree not to use, reproduce, distribute, or create derivative works from any content on the Website/App without the prior express written consent of Alivio.

10. Pricing

All prices for local services on Alivio are quoted in Indian Rupees and may be inclusive or exclusive  (specially B2B) of applicable taxes unless otherwise stated. Prices displayed on our Website/App are subject to change at the sole discretion of Alivio without prior notice. Confirmed bookings will not be affected by any price revisions; however, customers may be liable for any changes in statutory taxes or government levies.

Partners acknowledge and agree that they are obligated to provide services for both B2B and B2C orders allocated by Alivio. For B2B orders (including but not limited to hotels, schools, and offices), rates may be lower due to bulk volumes. Partners shall not, under any circumstances, modify or alter such rates at their sole discretion.

11. Modes of payment

Alivio shall settle monthly order payments on the last day of each month. Partners may track their earnings at any time through the portal. Any individual income tax or similar statutory liability arising from such earnings shall be solely borne by the Partner followed by Indian Income Tax Law. Alivio shall not be responsible for the payment of any individual income tax or similar statutory liabilities arising from a Partner’s earnings.

12. Termination

12.1 Alivio reserves the right, at its sole discretion, to deregister you from its platform or terminate your access to the Website/App and its services if it believes that you have breached, violated, abused, or unethically manipulated any of these Terms.

12.2 Upon termination by either party, Alivio may delete any content, data, or materials associated with your use of the service. Alivio shall not be liable to you or any third party for any loss, damage, or consequences arising from such actions.
12.3 You remain responsible for payment of any services or products ordered or utilized up to the effective date of termination by either party.
12.4. The Partner and any helper engaged by the Partner shall not engage in any form of sexual activity at a customer’s premises under any circumstances. If any such conduct is reported or evidenced, the Partner’s account shall be immediately suspended or permanently blocked, and appropriate legal action shall be initiated in accordance with applicable Indian laws. All legal costs, penalties, or expenses arising from such incidents shall be solely borne by the Partner and may be recovered from the Partner’s account.
12.5 Penalty Clause
Partners are strictly prohibited from sharing their personal contact details with Alivio customers and from accepting orders directly from customers outside the Alivio platform. Any violation will attract a penalty of ₹2,00,000 per instance, along with possible suspension or termination and legal action by Alivio

14. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms, or any service or product provided by Alivio through the Website/App or telephonic bookings, shall be subject to the exclusive jurisdiction of the courts of Kolkata.
